Posts: 148 (02/02/05 15:39:12) Reply Quote More My Recent Posts Message Me Connection Blocking Invite Ignore User's Posts	Tags : None Just noticed that the volunteer lookup service "Books We Own" at rootsweb (www.rootsweb.com/~bwo/contrib.html) has this notice on it: "Please note: I can no longer list CDs published by Genealogy.com, HeritageQuest, Ancestry.com, Family Tree Maker, any of their subsidiaries, or any of their parent companies. Any CD submissions will be disregarded. I apologize for any inconvenience this may cause." Ads and feeder links to Ancestry are one thing, but this really stinks.

Asking someone to break federal laws so you can save a few bucks is not a nice thing.

Posts: 148 (02/15/05 14:12:09) Reply Quote More My Recent Posts Message Me Connection Blocking Invite Ignore User's Posts	The thrust of the volunteer "Books we own" list is not an aid to pirating copyrighted text from various books and CDs. Maybe occasionally something like that might happen, where a book owner sends off tens of pages of content, but that's rare, I'm sure. Mostly it's reporting (uncopyrightable) facts from a source, or snippits which would fall under fair use. It's not like it's an automated service sending out the source on demand. Users of the contact list are not asking the volunteers to violate federal law. They are taking the volunteers up on their gracious offer to read specific sections of a source and report back what is found. No crime there. This is all fine with Rootsweb's masters, Ancestry.com. Except, it appears, if the volunteers might have bought one of Ancestry's products. That's the smelly thing.

They have a license, and the license prevents people from using the material for regular (not occasional) lookups. Everyone who purchases those CDs accepts that license before they can use them. That's why Books We Own can't use them. It's in violation of the license, not the copyright to share the data on them on a regular basis. Like it or not, their legal department covered all the bases.

Notice it always says Fair Use . doing a look up is not violating anylaws . It is fair use . You can't copyrite documents that are in the public domain . Next you will try and copywrite the english langauge , Check websters , does it not have a copywrite

You agree to that license before you use the CD for the first time. Ancestry is probably well aware of the loopholes in the copyright laws, and that is why they license their products. The license, which restricts usage, is what they will use in court if they decided to pursue it, not copyright violation. With a copyright, fair use does apply. However, Ancestry isn't relying on the copyright, it's relying on it's binding legal license which everyone who uses their products accepts before they use it, and there is no "fair use" clause in the license agreement. The copyright laws don't override a license agreement a person agrees to of his own free will. So, if Rootsweb listed one of Ancestry's CD's as one of the "Books We Own" someone would be violating the license agreement, not the copyright.
