New Ancestry trick ? |
Lead | |
|
I know that Ancestry has an automatic renewal policy and quite frankly that scares me off. I did however buy FTM from them and with it came a discount subscription to a magazine. Now, a year later, I just got a "Thank You" from them for renewing the subscription. Guess what...I never renewed. Is this legal?

I don't know the answer to your question but You probably checked off that you agreed to some terms and conditions or similar which included auto renewal. If you don't want the magazine, you can try calling them or if they have charged your card, you can do as I successfully did, call your credit card company and dispute the charge.

Hmmm. Tom Stockham was one of the leaders of Ticketmaster when this occured:
www.oag.state.ny.us/press...7a_02.html And he was president of MFI: www.ancestry.com/learn/li...ticle=4629 eogn.typepad.com/eastmans...am_le.html But he seems to of bail before the scams hit the fan. I guess timing is everything. |

New Ancestry Trick? | ||
|
It may or it may not be legal. Because of continuing complaints about "advanced consent" subscription plans, various jurisdictions are now placing limitations on them The FTC has also stepped in on some types of "advanced consent" plans and place restrictions on how they may be offered and to what extent they maybe enforced.
The problem has been noticed with the Direct Marketing Association, among others, issuing advisories to their members on how to avoid legal problems. In fact, the DMA has issued guidelines for its membership. See www.the-dma.org/guideline...sent.shtml Because the rules and regulations now vary widely between localities, state and federal law, you may want to contact the Consumer Protection department within your state government. Typically that department may be found in the state attorney general's office. I might add that in most jurisdictions, the one standard that must be achieved is that the advanced concent clause be in "clear and conspicuous" language. That's something Ancestry did not always follow in the past. They have become much better at it in recent years although I believe arguments can be made that its not conspicuous enough. Good luck. Re: Sounds typical to me

Ralf,
What makes you think the scam is about to hit the fan? I have seen nothing to that effect. I believe Tom was brought in becaues of his ticket master experience not in spite of it and doubt if his departure will change much. The closest thing I have seen was when Ancestry started telling monthly subscribers fall 2003 that they had committed for a year and "out of the goodness" of their hearts they would let them out of the committment for a $50 cancellation fee. There was nothing on their website that clearly stated the yearly committment or the $50 cancellation fee. Not long after it was "clarified" (see link) The monthly subscriptions through the front door disappeared. boards.ancestry.com/mbexe....1.1.2.1.1 |

Tom's history, want to buy a hearing aid? |

Re: Sounds typical to me

I already have hearing aids. I have been diagnosed wuth Trigeminal Neuralgia caused by surgery for a tumor that the Drs. couldn't find. As a result my hearing is very poor because I can't wear my hearing aids and my left ear is extremely painful at times, Thank you very much. I asked a simple question in response to your post and don't appreciate a smart ass answer.
I saw nothing in what I read of the Ticketmast/Time credit card abuse case that included names. I don't know if Tom left Ticketmaster before the stink, because of the stink, or as part of the agreements reached at the time. Do you? Since Tom left MFI rapidly and the employee's were quietly told, this suggests to me he was asked to leave. I have seen nothing that indicates the scam is about to hit the fan and I don't see his departure as an indication of this. I can delete the link to your web site pretty fast. |

Check out Tom's history with the hearing aid company he founded. Also look at the dates of the news releases i posted above.
I don't know who you are, or the status of your hearing health, so the reference was not made to you personally, but to Tom's hearing aid company having multi-million dollar lawsuits filed against it shortly after he sold it. Lawsuits tend to follow his departures. This thread was about auto-renewal of subscriptions and the legality of it. I was noting that the timing was quite the coincidence. You could say it almost is a pattern. |

Re: Sounds typical to me

Hi Ralf,
I had forgotten about his hearing aid company that I had read about in his bio so the inference went over my head. I interpeted it to mean something entirely different. I did not interpret it as related to my hearing and ear problems though because there is no way you could know but recent severe problems have made me a little sensitive in that area so I got a little hot under the collar. Now that you have reminded me of his hearing aid company, I realize I was wrong and apologize for my response. I sure do not want to debate you, you would bury me. That only makes me believe even more though that he was hired to do just what he did. MFI had to know. Has he bailed out for the third time or being kicked out. From the links below it looks like Sonic's trouble was fror a period of time he was at Ticketmaster. www.bermanesq.com/Securit...caseid=150 |

Re: Sounds typical to me

I realized how you took that, and I understand how one can be sensitive to that, so I had no intention of flaming for it. The problems with Sonic Innovation happened right after Tom left, if I remember the articles I researched a few years ago about it, the problem was hidden from the investors who purchased the business. Tom sold it quickly, and left problems behind, which were created during his tenure.
I do agree he was hired to make ancestry and MFI grow rapidly. I also think he was trying to get an IPO off the ground, which is his specialty according to his various resumes posted. I think it is pretty sad that a company doesn't have enough faith in its own product, that they have to resort to such tactics to keep you subscribed. |

It is also sad that a company and those in bed with it have discarded any ethics in the process, including particularly those that are so worried about the survival of Rootsweb. Of course the auto-renewal and acquirement of Rootsweb was before Tom. I think he certainly fine tuned the tactics with the satellites, very large number of links to Ancestry, increase in number of subscriptions available and the movement away from outside ads for some financing to in-house ads and subscriptions carrying the load. Lets not forget OWT and all those links to Ancestry and AWT being relegated to a link on the OWT page. When the "preliminary" was released last year all those in bed with Ancestry proclaimed it was not just a search engine but included a stitcher and subscribers were paying for the convenence. Now a year later they are asking for help on fixing. Oh the stitcher is broken, we can fix OWT by removing seems to be the answer. So what is OWT now? OWT is still nothing but an end run around the promise that AWT (and WC) would always be free.
Rootsweb was acquired before Tom though so you are probably right that he was brought in to take them public as well. www.ancestry.com/learn/li...ticle=1732 |

Hey Ralf,
Do you answer those in bed with MFI. I don't waste my time. If you do please explain it to him what I said. He does not seem to be able to understand. |

Re: Sounds typical to me

I don't need anyone to explain simple facts to me. You implied something other than the truth, and I was merely setting the record straight.
Or was it the fact that you are a liar, intentionally spreading lies, that you wanted someone to explain to me? |

Re: Sounds typical to me

Anon never actually stated or implied that that WC or AWT isn't free. And the real blob isn't usually so quick to be crass and blatantly insulting. He uses quick wit and sacastic humor. Maybe one of the MFI whores got bounced there and has to hang here now.

Re: New Ancestry trick ?

I've been away for over a month and we're still discussing Ancestry's auto-renewal policy. The only thing that's changed on this board is Blob's name. Blob, I'm glad that your being more "genuine" now. That "2005" name would have become old after a few years.
guest, did you try cancelling your subscription? If so, did you have any problems cancelling it? |

It looks like some legislators have noticed ancestrys and others auto-renew policies also.

cancelling | ||

I called and got through quick enough. They "claimed" that the email didn't mean the subscription was renewed (even though it said it was)....so I suspect that automatic renewal of magazine subscriptions <IS> illegal and this was some marketing ploy to get you to call so they could peddle something.
End result was they are giving me 2 more issues and then I have to suffer through this again. |

re: cancelling | ||

guest, if your so paranoid about this magazine subscription, why didn't you just tell them to cancel the whole thing and stop sending magazines? By allowing them to send you two more issues you've just prolonged your agony.
